Terms of Service

1. Acceptance of Terms

By accessing or using Art & Mind (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Art & Mind provides the online edition of the book Art & Mind, a reader for it with course tools for instructors and students, and decision-making tools, including weighted decision tables and uncertainty modeling, to help users analyze complex choices.

We may update or change the Service.

3. User Accounts

To access certain features, you may need to create an account. You agree to:

• provide accurate and complete information when registering;
• keep your account credentials secure;
• notify us immediately of any unauthorized access to your account;
• be responsible for all activity that occurs under your account.

Most readers sign in with a link we email to them, so a sign-in can lapse. When it does, you sign in again with a new link. A lapsed sign-in does not change what you have access to.

4. User Content and Data

You retain ownership of all decision data, ratings, and content you create on Art & Mind (“User Content”). By using the Service, you grant us a limited license to store and process your User Content to provide the Service, display it back to you within the app, and back it up to prevent loss.

You are solely responsible for the accuracy, legality, and appropriateness of your User Content. We do not claim ownership of your decisions or data. How we handle personal information is described in our Privacy Policy.

5. The online book

How you get it

You get the online book by buying it on this site, buying it through a course’s page, or redeeming a code, such as a bookstore code or a gift code.

How long it lasts

Book access is recorded on your account with no expiry date. It does not depend on any course, and it continues after your course ends.

What it covers

Book access gives you a personal, non-transferable license to read Art & Mind in the Art & Mind reader, and to add your own notes to it. You agree to keep the book within the reader, and not to redistribute, bulk-copy or share it. The book remains the property of its authors and publisher. The book cannot be downloaded, and the book view does not allow printing or copying; the Accessible Text view allows copying passages for study and accessibility.

Previews

Anyone can read the Introduction and Chapters 1 and 2 free. Joining a course, including through a learning-management system, does not by itself include the book; without it you see the free preview.

6. Courses

If you join a course that uses Art & Mind, these terms also apply.

Course enrollment is separate from book access. While you are enrolled, it gives you your instructor’s readings, your discussion group and your assignments. It ends if your instructor removes you from the course. Your book access continues when an enrollment ends, and coursework you did while enrolled is kept for your instructor.

Annotations, comments and replies you post are shared with your assigned discussion group and your course instructor. Do not post anything you would not want your instructor or classmates to see.

Your instructor may use your participation and engagement metrics as part of a course grade. Final grades are recorded in your school’s own system, not here.

If an instructor deletes a course, the comments and notes made in that course are deleted with it.

You can download your own notes from a course as a PDF, in color or for printing, or copy them, from the “My notes” button in the reader.

7. Prohibited Conduct

You agree not to:

• use the Service for any illegal or unauthorized purpose;
• attempt to gain unauthorized access to our systems or other users' accounts;
• upload malicious code, viruses, or harmful software;
• scrape, harvest, or collect data from the Service without permission;
• impersonate another person or entity;
• interfere with the proper functioning of the Service;
• violate any applicable laws or regulations.

8. Intellectual Property

All content, design, code, logos, and trademarks associated with Art & Mind are owned by us or our licensors. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service without our written permission.

The Art & Mind name, logo, and associated branding are trademarks. Unauthorized use is prohibited.

9. Disclaimers and Limitations of Liability

No Professional Advice

Art & Mind is a decision-support tool, not professional advice. We do not provide legal, financial, medical, or career counseling. You should consult qualified professionals before making important life decisions.

“As Is” Service

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Art & Mind and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless Art & Mind, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• your use or misuse of the Service;
• your violation of these Terms;
• your User Content or decisions made using the Service;
• your infringement of any third-party rights.

11. Ending access

We may suspend or end an account that breaks these Terms, or that is used for fraudulent, abusive or illegal activity. When we end an account, its access to the Service ends, including access to the online book.

You can ask us to delete your account by writing to the contact address below. Deleting your account ends your access, including to the online book. What deletion removes is described in our Privacy Policy.

Sections of these Terms that by their nature should survive termination (for example, disclaimers, limitations of liability and indemnification) will remain in effect.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the State of Oregon, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You waive your right to a jury trial.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a new date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Art & Mind regarding the Service and supersede any prior agreements.
