1. Acceptance of Terms

By accessing or using Art & Mind (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Art & Mind provides decision-making tools, including weighted decision tables and uncertainty modeling, to help users analyze complex choices. The Service is provided "as is" and may be updated, modified, or discontinued at any time.

3. User Accounts

To access certain features, you may need to create an account. You agree to:

• Provide accurate and complete information when registering
• Keep your account credentials secure
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. User Content and Data

You retain ownership of all decision data, ratings, and content you create on Art & Mind ("User Content"). By using the Service, you grant us a limited license to:

• Store and process your User Content to provide the Service
• Display your User Content back to you within the app
• Back up your data to prevent loss

You are solely responsible for the accuracy, legality, and appropriateness of your User Content. We do not claim ownership of your decisions or data.

Course Access and Student Participation

If you join a course that uses Art & Mind, the following additional terms apply:

• Purchasing course access grants you a personal, non-transferable license to read the assigned book and any instructor-provided readings, and to annotate them within your course.
• Annotations, comments, and replies you post are shared with your assigned discussion group and your course instructor. Do not post anything you would not want your instructor or classmates to see.
• Your instructor may use your participation and engagement metrics as part of a course grade. Final grades are recorded in your school's own system, not here.
• You agree to keep the book and readings within the reader and not to redistribute, bulk-copy, or share them outside the course. The book remains the property of its authors and publisher.
• Course access is tied to your enrollment and may end when the course concludes.

5. Prohibited Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Upload malicious code, viruses, or harmful software
• Scrape, harvest, or collect data from the Service without permission
• Impersonate another person or entity
• Interfere with the proper functioning of the Service
• Violate any applicable laws or regulations

6. Intellectual Property

All content, design, code, logos, and trademarks associated with Art & Mind are owned by us or our licensors. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service without our written permission.

The Art & Mind name, logo, and associated branding are trademarks. Unauthorized use is prohibited.

7. Disclaimers and Limitations of Liability

No Professional Advice

Art & Mind is a decision-support tool, not professional advice. We do not provide legal, financial, medical, or career counseling. You should consult qualified professionals before making important life decisions.

"As Is" Service

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Art & Mind and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service.

You agree to indemnify and hold harmless Art & Mind, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your User Content or decisions made using the Service
• Your infringement of any third-party rights

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may also delete your account at any time. Upon termination, your right to use the Service ceases immediately.

Sections of these Terms that by their nature should survive termination (e.g., disclaimers, limitations of liability, indemnification) will remain in effect.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the State of Oregon, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law. You waive your right to a jury trial.
